A Cork GP jailed last month for indecently assaulting a 15-year-old girl 26 years ago has been granted bail pending an appeal.
Kevin Mulcahy (57), of Creggan, Lombardstown, Mallow, Co Cork, had pleaded not guilty to a single charge of indecently assaulting the girl while on call to her family home on December 23rd, 1989.
He was found guilty by a jury at Cork Circuit Criminal Court following 39 minutes of deliberations and jailed for two years by Judge Seán Ó Donnabháin on November 25th last.
Mulcahy was granted bail on Thursday on consent by the Court of Appeal pending an appeal against conviction and sentence.
Consented to bail
Mr Justice George Birmingham said the chief prosecution solicitor had consented to bail on a number of conditions.
Mulcahy was required to sign on three times a week between the hours of 9am and 9pm at a Cork Garda station.
As he was required to attend the Garda station on Mondays, Wednesdays and Fridays, his barrister, Blaise O’Carroll SC, asked whether he would be required to sign on on Friday week, Christmas Day, but the court heard that such a requirement would be relaxed.
Mr Justice Birmingham, who sat with Mr Justice Garrett Sheehan and Mr Justice Alan Mahon, fixed February 9th next as the date for his appeal against conviction and sentence.
