A 21-year-old Spanish national arrested in the Phoenix Park on Monday morning was remanded in custody with consent to bail at Dublin District Court yesterday.

Garda Pat Conroy of Cabra station gave evidence of arresting Mr Ricardo Cueto Gutietiez, of no fixed abode, in the park at 1 a.m. on January 24th. He charged him with an offence under Section 112 of the Road Traffic Act - stealing a Volkswagen Golf car in Cork last Sunday - and indicated that he would face further charges.

The garda objected to bail on the grounds that the accused had no fixed address, had at first given a false date of birth and because he faced further charges. He believed he might abscond.

The defending solicitor, Mr John Feaheny, submitted that the reasons given were not sufficient to refuse bail. It was no concern of the court if the defendant was to face further charges, he said.

Judge David Anderson said he would refuse bail if the accused was unlikely to turn up for his trial or if he were likely to interfere with witnesses, but there was no evidence before the court to this effect.
