Fine Gael deputy Mr Jim Higgins has withdrawn his challenge to discovery orders made against him by the Morris tribunal for production of certain of his phone records.

His lawyers said the person who contacted him informing him he was to receive a fax containing certain allegations is consenting to their identity being disclosed.

Labour TD Mr Brendan Howlin is persisting with his action but the case was adjourned while tribunal counsel gets instructions on whether it is necessary for the tribunal to continue to seek Mr Howlin's phone records.
