The Supreme Court yesterday adjourned until October a decision on who should pay the costs of the proceedings before it. The appeal had been at hearing before the Supreme Court last month for four days. Total costs are estimated at more than £300,000.
The case had been at hearing for six days in the High Court last April. The High Court ruled that the State should pay the Haugheys their costs of three days of the six-day case. Lawyers for the Haugheys had sought costs of the six-day hearing.
Following its judgment yesterday, the Supreme Court did not make any formal order in relation to the discovery orders which were successfully challenged by the Haugheys.
A list of the orders involved is to be considered by lawyers for the two sides to see if they can reach agreement. If agreement is not reached, the sides have liberty to come back to court.
