‘No fault’ approach to medical negligence

Sir, – In July 2015, following the admission of negligence in the High Court by the HSE in the birth of our daughter, we called for fundamental reform to the medical negligence system in Ireland.

The comments of the parents of Eoin McCallig last week indicate absolutely nothing has changed, with the HSE continuing to apply a policy of denial (News, November 21st).

In New Zealand the “no fault” approach to medical negligence cases allows doctors to admit to their mistakes and apologise to patients.

This approach avoids families having to waste years of their lives going through the courts while in many cases having to care for profoundly disabled children with zero support.
