CLOSING submissions will continue this morning at Belfast Crown Court in the trial of two men for the murder of a Newry postal worker nearly two years ago.
Mr Declan McComish (98) Regina Park, Jonesborough, Ceo Armagh, and Mr Kevin Patrick Donegan (39), Bayview, Co Armagh, deny the murder and involvement in the armed robbery of £131,000 from the post office sorting depot at Newry, which was admitted by the IRA.
Mr Kerr (54) was shot and fatally wounded as he grappled with an armed raider who had forced his way into the cashroom on November 10th, 1994. The court has heard that the defendants were arrested less than an hour after the robbery when police stopped Mr McComish's car near the village of Meigh.
As police approached, a third man left the rear of the vehicle and ran off, making his escape in spite of shots being fired.
Yesterday, Lord Justice Nicholson turned down defence submissions that there was no case to answer. Neither accused was called to give evidence.
