Perth - Dangerous driving charges against the New York-based author and international art critic Robert Hughes should be reinstated because the magistrate who dismissed the case had erred in fact and in law, a court was told here yesterday.

Prosecutors in Western Australia are appealing an earlier decision to dismiss the case against Mr Hughes (60). He was charged with dangerous driving and causing grievous bodily harm. He pleaded not guilty. His rented vehicle and another car collided head-on in a horrific crash on May 28th last year.
