A city centre man has had the balance of his six-year sentence for a 1995 offence reactivated by Dublin Circuit Criminal Court because he failed to abide by bail conditions imposed in July.
Duane Brady (24), of Summerhill Road was jailed in March 1998 by now retired Judge Kieran O'Connor for attempted robbery of a handbag from a car in April 1995 when he was 16.
Ms Pauline Walley, prosecuting, told Judge Desmond Hogan the sentence was backdated to January 30th, 1997, and Donovan was released on December 16th, 1998, on conditions involving his co-operation with the Probation and Welfare Services concerning his chronic heroin addiction.
Ms Walley said Donovan's sentence was reactivated on November 17th, 2000, and he was in prison again until March 16th, 2001, when his sentence was suspended for a second time.
Donovan was brought back before the court in July 2003. The matter was again before the court yesterday as a result of the probation officer reporting she could not be of any further assistance to him as had failed to abide by the conditions imposed in July.
Ms Caroline Biggs, defending, appealed for a further chance for Donovan and submitted that he had already served a substantial portion of his sentence, which would have expired in January 2001 had he served it all straight through.
Judge Hogan said Donovan's attitude was a classic case of "O Lord, make me pure, but not this week".
