A DUBLIN prostitute and heroin addict who agreed to perform oral sex for £30 told the Central Criminal Court she was kidnapped, raped and sexually degraded in the Wicklow mountains by two men. The mother of two, told the jury she believed the men would kill her.
The sexual assaults went on for some hours and after the men dressed themselves, one of them got something out of the boot of the car. She was afraid it was a weapon to hit her. They drove her back to Rathfarnham, put her out of the car and ordered her not to look at the registration.
A married couple who came to her aid told the jury she was "in an awful state".
A 36 year old man has pleaded not guilty to three charges of raping the woman, falsely imprisoning her and sexually assaulting her by forced oral sex on the night of December 29th-30th, 1994.
Mr Justice Michael Moriarty and the jury were told by prosecuting counsel, Ms Maureen Clark SC (with Mr Pat O'Connell), that the trial would continue for some days with substantial legal argument in its absence.
The alleged victim told the jury she had agreed to perform oral sex with the driver of the car for £30. She had only been at her pitch for a few minutes when he met her. He said he was going to drop his passenger in Ranelagh but instead they both drove her up the mountains where they assaulted her.
When she said she wanted to get home to see her children and her mother they ordered her to shut up and threatened to kill her.
When the driver forced her to have sexual intercourse she told him she had AIDS and gave him a condom from a packet she carried. He later threw this condom along with tissues and empty cigarette packets out of the car at the scene.
She claimed the driver said to his passenger "Look at her - she loves it" while they carried out repeated degrading acts. She did not consent to these acts or to the sexual intercourse.
The alleged victim had been a prostitute and junkie who solicited against her boyfriend's will to get sufficient money to feed her heroin habit.
She only carried out oral sex and masturbation, always using a condom. After she had earned £120 on any night she stopped.
Ms Clark said gardai recovered a used condom and other rubbish from the scene of the alleged rape as a result of the woman's statement.
Ms Clark told the jury the second man in the car continuously called the driver by a Christian name which was also the accused's Christian name. The driver repeatedly ordered his companion to call him by another name, the woman told gardai.
The alleged victim was also able to identify the model of Ford car driven by her attacker. "All these bits of evidence will, in the prosecution's view, lead you as jurors to find the accused guilty of the charges against him," Ms Clark said.
Ms Clark said the woman had agreed to perform oral sex on one man for £30 but had been kidnapped and humiliated by both men. "She didn't consent to what was done to her and she is entitled to her bodily integrity," said Ms Clark.
