Supreme Court has been asked to explain a new Act aimed at simplifying legal proceedings against people refusing to pay water charges.

The Circuit Court President, Mr Justice Frank Spain, yesterday overturned a District Court order permitting South Dublin County Council to cut off a domestic supply for non-payment.

Mr Martin Giblin, representing Tallaght householder, Mr Liam Walsh, said the council's failure to call the authorised officer to prove his statement, viva voce, was fatal to its application for an order permitting discontinuance of supply.

Mr John Gallagher, senior counsel for the local authority, was granted leave to state a case to the Supreme Court.
