Morris tribunal:Donegal publican Frank McBrearty jnr failed to appear at the tribunal yesterday after walking out of the inquiry on Tuesday.

He had left during cross-examination by a solicitor for a garda who had questioned him when he was arrested a decade ago during the investigation into the death of Richie Barron.

The tribunal has adjourned the sub-module into Mr McBrearty's complaints that he was mistreated when arrested a decade ago. The sub-module into the detention of his father, Frank McBrearty snr, resumes today.

Mr Justice Frederick Morris said on Tuesday Mr McBrearty jnr was overwrought and "under a considerable amount of pressure".

He still faces cross-examination by legal teams representing former Det Sgt John White and former Garda John O'Dowd, who questioned him during his arrest on February 4th, 1997, in connection with an alleged nightclub assault on Edward Moss. He was acquitted of all charges.
