A 36-year-old Dublin man who has been in custody for the last 29 months was yesterday granted bail following a decision by the Director of Public Prosecutions to enter a nolle prosequi in relation to two charges of statutory rape of a girl aged 16.

The man was due to appear before the courts on June 29th. However, the State applied before Judge Katherine Delahunt in the Dublin Circuit Criminal Court on Thursday to have him appear before her yesterday.

The DPP entered a nolle prosequi in relation to two counts under Section 2 of the Criminal Law Amendment Act, 1935, as amended by section 13 of the Criminal Law Act, 1997.

The man still faces a third charge in relation to a non-sexual assault on the same girl.

Under the terms of bail granted by Dublin Circuit Criminal Court, the man will have to live on Dublin's northside and sign on three times a week at a local Garda station.

Counsel for the man, Marie Torrens, said she would be writing to the DPP in relation to the case.
