A 24-year-old man was yesterday remanded on bail after he was charged with the manslaughter of his brother who drowned when their car plunged off a quay and into the sea in Cobh earlier this year.
Edward O'Mahony from Springfield Park, Cobh, appeared at Cobh District Court yesterday morning where he was charged with the unlawful killing of his brother, Patrick (26), at Deep Water Quay, Cobh on July 7th last.
Both Edward O'Mahony and Patrick O'Mahony ended up in the sea when their Ford Focus car went off the quay at about 1.40pm on the day in question. Edward O'Mahony managed to make it to the quayside but Patrick O'Mahony perished in the incident.
Yesterday, in addition to being charged with his brother's manslaughter, Edward O'Mahony was also charged with endangerment at Deep Water Quay and with driving while under the influence of an intoxicant at Westbourne Place earlier on July 7th.
Sgt Pat Murphy gave evidence of arrest, charge and caution and said that Edward O'Mahony made no reply to any of the three charges when they were put to him after caution. Mr O'Mahony had been co-operative with gardaí investigating the incident, he said.
Supt Pat Sheahan said that gardaí had no objection to bail and Judge Michael Pattwell remanded Mr O'Mahony on his own bail of €100 and an independent surety of €1,000, to appear again at Cobh District Court on January 24th.
Judge Michael Pattwell was told that gardaí expect to be in a position to serve the book of evidence on Mr O'Mahony on that date with a view to seeking a return for trial to the next sittings of Cork Circuit Criminal Court.
