THE second day of the trial of a man who denies kidnapping and raping a Dublin prostitute was with legal argument held yesterday in the jury's absence.

The 36 year old defendant has pleaded not guilty in the Central Criminal Court to three charges of raping the woman, falsely imprisoning her and sexually assaulting her in the Wicklow Mountains on the night of December 29th/30th, 1994.

On Monday, the court was told the alleged victim was a prostitute in 1994 soliciting against her boyfriend's wishes for money for heroin.

The young mother of two told Mr Justice Moriarty and the jury she performed only oral sex and masturbation, always using a condom. After earning £120 on any night, she stopped.

She said on the night of December 29th, 1994 she agreed to oral sex with the driver of the car for £30. The man said he was going to drop his passenger in Ranelagh but instead he drove her to the mountains where he and another man in the car assaulted her.

The woman claimed the driver said to his passenger. "Look at her, she loves it." He also threatened to kill her while they carried out degrading acts. She did not consent to these acts or when the driver had sexual intercourse with her.
