A woman has told the High Court that she woke one morning to find her hallway, shower and utility room flooded. Another time water came through the ceiling and she was also quite frightened when "a waterfall" came down a wall in front of her as she got out of her car in the garage. She and her husband had secured a court injunction the same week.
Ms Justine McCarthy, a journalist, was giving evidence yesterday in the action by her husband, Mr Denis Murnaghan, a solicitor, for damages arising from the development of apartments on a site adjoining their former home at Pembroke Place, Dublin.
The action is against Markland Holdings Ltd (MHL), Dublin, and Cantier Construction Ltd, with registered offices in Limerick, which went into voluntary liquidation last year.
Ms McCarthy said MHL got planning permission in 2001 to build a premises beside them. It did not concern her at first. It was only when the light was blocked to their roof garden that the implications of a wall which the company had built became apparent.
She worked from home on Fridays and was experiencing a lot of noise. She had pointed out to two men standing on the Markland building that there was a High Court order in being. One of them said in an aggressive voice there was no need to tell them about that.
