A HIGH court judge will rule next week whether an action by former assistant Dublin city and county manager George Redmond against the planning tribunal can proceed.
Mr Justice Paul Gilligan has to decide whether Mr Redmond’s six-year delay in pursuing his action aimed at overturning a corruption finding against him was justified. The judge said he would rule on that matter on March 28th.
Mr Redmond (88) claims the delay was justified on grounds of alleged concealment by the planning tribunal of documents relevant to the credibility of its main witness, James Gogarty.
The case arises from a finding made in 2004 by the tribunal, in its third interim report, that Mr Redmond received a corrupt payment in relation to planning matters and had also obstructed its work.
In 2005, Mr Redmond brought his High Court action seeking to quash those findings.
He claims his constitutional rights have been breached and he has also sought damages. He has also challenged a costs order made against him.
Last January, the tribunal sought to have his action dismissed because of the delay in prosecuting it.
