The Director of Public Prosecutions is to proceed with a retrial of Dermot Laide for the death of Brian Murphy (18) outside Dublin's Club Anabel in August 2000.

The Court of Criminal Appeal quashed Mr Laide's original conviction and four-year sentence for manslaughter last February and ordered a retrial.

Laide (23) from Castleblaney, County Monaghan is currently serving the remainder of his two-year sentence for violent disorder and with one-quarter remission would be due for release in September.

Last month, co-accused Desmond Ryan (24), of Cunningham Road, Dalkey, Dublin, who was given nine months on the violent disorder charge, walked free when the Court of Criminal Appeal quashed his conviction but did not order a retrial.

Four men were charged in connection with the death and three of them - Dermot Laide, Desmond Ryan and Sean Mackey - were convicted of violent disorder.

Laide was also sentenced to four years for the manslaughter of Brian Murphy but this conviction was quashed by the Court of Criminal Appeal last February.

At the Court of Criminal Appeal today, senior counsel Brendan Grehan, representing the DPP, confirmed that a retrial would be sought.

His senior counsel Michael O'Higgins said there were two outstanding issues in relation to the case.

However Judge Brian McCracken said he would be unable to hear them because two of his colleagues in the three judge court were absent.

Lawyers for Desmond Ryan, whose conviction for violent disorder in relation to the death of Brian Murphy was also quashed last February said they would also be seeking costs on his behalf.

Judge McCracken said the submissions for both men should take place at the same time but added that he would not be able to give a specific date.
