AN Algerian man, married to an Irish woman, and who was deported last month, is now back in the State, the High Court was told yesterday.
Mr Madani Haouanoh was taken from Dublin to Heathrow Airport by immigration gardai and then put on a plane to Algeria on Tuesday, October 29th. On the same day the High Court granted an order preventing his deportation.
Following this, lawyers for Mr Haouanoh sought orders to have two immigration gardai and two officials of the Department of Justice jailed for alleged contempt of court.
Mr Haouanoh had lived in Dublin since 1991 and married an Irish woman in 1993. He had travelled to France in October but was detained when he returned to Dublin as he had no re entry visa.
Yesterday, Mr Peter Finlay, counsel for Mr Haouanoh, said he was happy to tell the court that Mr Haouanoh was now back in the State. The matter could now be struck out. He said that he would be quite pleased if the motions for committal to prison would now not proceed.
Mr Diarmaid McGuinness SC, for the Minister for Justice and all other parties, said he agreed that all proceedings should be struck out and that motions should not proceed. He asked that there be no order for costs.
