A Co Donegal businessman had the final charges against him withdrawn at a sitting of Letterkenny District Court this week. More than 150 summonses against Mr Frank McBrearty and members of his family were withdrawn by the DPP in June.

Mr McBrearty and five other defendants, including members of his family and staff, faced a further six summonses and one charge sheet.

Public order charges against Mr McBrearty snr, Mr Frank McBrearty jnr, Ms Geraldine McElwee, Mr Frank McElwee, Mr William Doherty and Mr Mark McConnell relating to an alleged incident in the foyer of Letterkenny Courthouse in 1998 were withdrawn at Tuesday's sitting.

Mr Peter Nolan, defence counsel, said the charges all formed part of the Carty commission report. He asked Judge John O'Donnell for a lengthy adjournment on two remaining charges.

"I doubt whether the Carty report will ever see the light of day and I ask for an adjournment as long as possible to see what the report brings," Mr Nolan said.

Judge O'Donnell adjourned the matter to January 25th for mention with a view to fixing a hearing date.
