A 12-year-old boy who broke his wrists when he fell awkwardly in a long jump sandpit, has failed in a £30,000 damages claim against his school and the Minister for Education.
Robert Arnold, of Thornville Avenue, Kilbarrack, Dublin, claimed his injuries had been caused at Greendale Community School by compacted sand which had not been properly dug up.
Judge Bryan McManhon was told the boy had disobeyed a class instruction to stop jumping and had injured himself after whizzing past the teacher attempting to get in a final jump.
Judge McMahon O hOisin, counsel for the school, that said he accepted the sandpit had been safe and adequately prepared.
