A body builder, whose lip was lacerated and who had a number of teeth broken when a dumb bell fell on his face, has settled a personal injuries claim against his former gym.

Judge Esmonde Smyth was told in Dublin Circuit Civil Court that Mr William Goggins (34), a civil servant, of Cabra, Dublin, was performing a pull over bench exercise when the dumb bell disintegrated and more than 10 kilos of iron hit him in the mouth.

The Phibsboro Gym denied liability, claiming Mr Goggins, an experienced body builder, should have known to use a fixed weight dumb bell.

When it was held that gym instructor Mr Philip Kelly had given evidence during cross examination by Mr David Nolan, "counsel for Mr Goggins, conflicting with what he had earlier told the court, Judge Smyth adjourned the hearing to facilitate talks between the two sides. Mr Nolan later told the court the matter had been settled and was granted an order for costs against the gym.
