A midwife and mother has taken a High Court challenge to the South Eastern Health Board's view that, while pregnant with her sixth child, she was not a suitable candidate for a home-birth delivery.

Ms Marie Nevin Maguire (42), and her husband Paul, of Cheekpoint, Co Waterford, are seeking a declaration that the health board was obliged to provide her with a domiciliary midwife service in connection with her pregnancy in 1999.

They also want a declaration that if the health board did not wish to provide the service sought, it was obliged to reimburse Ms Nevin Maguire the cost of acquiring a domicilary midwife.
