The Supreme Court today ruled in favour of Bupa in its appeal against the High Court's rejection of its challenge to risk equalisation. In a unanimous ruling the Supreme Court found that the minister for health Ms Harney had acted outside her power when requiring new companies in the private health insurance market to make risk-equalisation payments to the VHI to compensate it for its older and less profitable customer base.
