A judge has described as "unbelievable" the pain suffered by a man when the stabilising jack of a JCB digger was lowered on his foot.
Judge Carroll Moran, awarded driver Eamonn Mullan, of Summerhill Parade, Dublin, £8,000 damages against Bonfil Plant Hire, Castleknock, Dublin, in the Circuit Civil Court for a fractured big toe.
He said that while one could hardly imagine such pain he had to take into account the fact that Mr Mullan was back at work the next day and had not gone back to hospital except for a pre-ordained review three months later.
Judge Moran heard Mr Mullan had walked from the hospital, declining a plaster -cast or splint on his foot and would allow only a strapping on his toe.
