A 32-year-old sales director who broke his little toe while jogging has been awarded £7,500 damages against Dublin Corporation.

The Circuit Court President, Mr Justice Smyth, heard that Mr James Toal, of Seapark, Clontarf, Dublin, fell when a recently laid kerbstone tilted under his right foot.

Mr Justice Smyth held the corporation negligent in having removed a protective warning cordon from the site before fixing cement had fully solidified.
