A BOY who sustained stomach and other injuries after he was struck by a delivery van has secured €250,000 in settlement of his High Court action.

The court was told Michael Regan was aged five at the time of the incident on July 1st, 1997, and became very withdrawn after it. His mother said he had been a “happy little boy” beforehand, but was not the same since.

Michael, now 16, had, through his mother Evelyn Regan, of Montpelier Gardens, Dublin, sued Liam Mahon, of Prussia Street, Dublin, the owner of the van involved, and Raymond Murtagh, of Rivermeade Drive, St Margaret’s, Co Dublin, who was driving it at the time.

Liability was conceded in the case and the settlement was approved yesterday by Mr Justice Eamon de Valera.

Outlining the case, Richard Kean SC, for the boy, said the incident occurred on July 1st, 1997, at Montpelier Gardens. He said Michael was struck by the delivery van and received an injury to his stomach. He was taken to Temple Street hospital. He was traumatised and had problems at school, counsel said. In his claim, it was stated the boy had been taken to hospital complaining of pain in his abdomen and in his back. He had bruising on his face and body, and a swollen knee.

Mr Justice de Valera directed that €6,000 be paid now, with the remainder to be paid to Michael on his reaching the age of 18.
