BMW sues Roscommon mechanic over signs

Car manufacturer claims Edward Ronayne using ‘confusing and parasitic business name’

Car manufacturer BMW has alleged a mechanic engaged in "parasitic" use of its trademark in his motor servicing business.

Bayerische Motoren Werke (BMW), with registered offices in Munich, claims Edward Ronayne's "BMWCare" business at Ballyhaunis Road, Cloonfad, Co Roscommon, is being conducted in such a way as to mislead the public into believing there is an association with BMW.

It claims Mr Ronayne has sought to provide repair services for BMW vehicles using this “confusing and parasitic business name” on his stationery, invoices and a number of websites. He had not just reproduced the name BMW, but also reproduced the company’s iconic trademark, it alleges.

Mr Ronayne denies he is infringing the trademark.

BMW says, before it took High Court proceedings, it called on Mr Ronayne to desist but he failed or refused to do so. The company says it told him it had no objection to him referring to BMW in a legally permissible way.

The case continues.
