The determination on airport charges by the aviation regulator, Mr Bill Prasifka, will stand while Aer Rianta's appeal is being heard by a three-member panel.

Appointed by the Minister for Public Enterprise, Ms O'Rourke, it will comprise people with legal and economic expertise. They must complete their consideration within two months.

They have the option of confirming Mr Prasifka's decision or referring it back to his office. Mr Prasifka would have one month to confirm or amend his decision in that case.

Aer Rianta also has the option of seeking a judicial review in the High Court.
