Man remanded over boy's death

A man has been remanded in custody with consent to bail in connection with the killing of 15-year-old Nigerian teenager Toyosi Shittabey.

Paul Barry (38) from Pearse Street in Dublin is charged with the manslaughter of Toyosi at Mount Eustace Crescent, Tyrellstown, on Good Friday.

An application for bail was made on Paul Barry’s behalf this morning at Cloverhill District Court by his solicitor Michael Hanahoe in front of Judge William Early.

Detective Garda Tom Cooney from Blanchardstown Garda station objected to the bail application because of the “seriousness of the charge and the weight of evidence against the accused”.

Mr Hanahoe said he appreciated and conceded it was a serious charge and there was a “weight of evidence” against the accused but he said it was not a reason to refuse bail.

Paul Barry appeared alongside his brother Michael (23), from Pigeon House Road, Dublin, who has been charged under section 11 of the Firearms and Offensive Weapons Act with possession of a hockey stick in connection with the incident.

The older brother wore a green T-shirt and his left arm was in a sling. Michael Barry wore a cream-coloured hooded top. Neither man spoke during the short hearing.

Judge Early consented to bail and remanded Paul Barry in custody until April 20th. He ordered that the accused reside at a house in Pearse Street, sign on at Pearse Street Garda station, surrender his passport and not apply for another one.

The judge told Paul Barry he must stay out of the Dublin 15 area and make no attempt to contact any potential witnesses either on his own behalf or through a third-party.

The judge also ordered him to pay his own bond of €300 and provide two independent sureties of €30,000 each with €10,000 to be lodged in court on each account.

Michael Barry appeared in court today in relation to the conditions of his own bail. He was granted bail yesterday on condition that he provide an independent surety of €6,000, surrender his passport and stay out of the Tyrellstown area.

Michael Barry's solicitor Matthew Kenny said his client would be in a position to meet the bail conditions this afternoon.

A large number of people from the Nigerian community including Toyosi’s father Segun Shittabey and his eldest brother Sudeek attended the short hearing. Mr Shittabey was driven away in a Garda car afterwards.
