A MAN has been remanded in custody with consent to bail in connection with the killing of Nigerian teenager Toyosi Shittabey (15).

Paul Barry (38) from Pearse Street in Dublin is charged with the manslaughter of Toyosi at Mount Eustace Crescent, Tyrrelstown, on Good Friday. An application for bail was made on Mr Barry’s behalf yesterday morning at Cloverhill District Court by his solicitor Michael Hanahoe in front of Judge William Early.

The bail application was objected to by Garda Tom Cooney from Blanchardstown Garda station on the basis of the “seriousness of the charge and the weight of evidence against the accused”.

Mr Hanahoe said he appreciated it was a serious charge and there was a “weight of evidence” against the accused, but he said it was not a reason to refuse bail.

Mr Barry appeared alongside Michael Barry (23) from Pigeon House Road, Dublin, who has been charged under section 11 of the Firearms and Offensive Weapons Act with possession of a hockey stick. Paul Barry wore a green T-shirt and his left arm was in a sling. Michael Barry wore a cream-coloured hooded top. Neither man spoke during the short hearing.

The judge consented to bail and remanded Paul Barry in custody until April 20th. The judge ordered him to pay his own bond of €300 and provide two independent sureties of €30,000 each, with €10,000 to be lodged in court on each account.

The judge ordered that if the accused meets the bail conditions, that after April 20th, he may reside at a house on Pearse Street, sign on at Pearse Street Garda station, surrender his passport and not apply for another one. He must stay out of the Dublin 15 area while on bail and make no attempt to contact any potential witnesses on his own behalf or through a third party.

Michael Barry was granted bail on Monday on condition he provide an independent surety of €6,000, surrender his passport and stay out of the Tyrrelstown area. His solicitor Matthew Kenny said Michael Barry was in a position to meet the bail requirements yesterday afternoon.

A large number of people from the Nigerian community, including Toyosi’s father Segun and his brother Sudeek, attended the hearing.
