Sir, - Surely on the publication of the gazette notice relating Judge Lynch's relinquishment of his office of the Special Court, the Government (the executive in the person of Mrs Nora Owen) ceased to have any function in the matter. Thereafter, the clerk or registrar entrusted with the preparation of the Court Lists should alone have been concerned with what cases he could have put before Judge Lynch.
To suggest that the executive has anything to do with fixing lists is to suggest a serious breach of the Separation Powers. Likewise, the Attorney General had no function other than the duty, as has any other counsel, of pointing out to the judge his lack of jurisdiction. Yours, etc.,
Former Judge of the High
Court of Kenya,
Cross Street,
Athenry, Co Galway.
