A boy who violently threatened a female garda with a bottle when he was drunk, has been allowed home because there were no places available to remand him in custody.

The 15-year-old boy had been given bail in February at the Dublin Children's Court on a criminal damage charge on the conditions that he stay at home each night, not go to certain areas and keep out of trouble.

He was brought back to back to court last week because he had failed to adhere to these conditions.

Garda Colm Gallagher, Kilmainham Garda Station, said that on April 27th last the boy was seen in a block of flats in Dublin 8 where he was forbidden to enter. He was also arrested for breach of public order on that occasion.

On April 23rd last, the boy was also arrested after he obstructed gardai while they were arresting another person. Garda Gallagher said the boy was drunk and violent and threatened his colleague with a bottle.

He then escaped but was caught the next day in the same area, from which he also been barred. He was drunk again and when gardai tried to arrest him he became violent. The incident took place at 2 a.m. during his curfew hours.

Gda Gallagher said he would look to have the boy remanded in custody because he broke his bail and was a danger to himself and others.

Judge Patrick Brady then remanded the boy to Oberstown House for breaching his bail.

Today the Children's Court was told that the High Court made an order of Habeas Corpus and released the boy. Judge Mary Collins said she could then make no order on the case and allowed the boy go home.
