The second only prosecution in Dublin for underage drinking failed yesterday when a judge ruled that a bar manager had discharged his responsibility under law because he was about to check the age of two girls aged 15 as garda∅ arrived.

Mr Anthony Lowry, proprietor of the Peacock in Marlborough Street, and Mr John Black, the manager, denied serving the girls alcohol in February.

Dublin District Court heard the girls were with a young woman and two 18-year-old men, one of whom ordered pints of lager for the girls.

The girls admitted the drinks were for them. The manager said a barman had already checked one man's student card and the woman's Garda identity card.
