The solicitor for a company under investigation at the Flood tribunal has been told by the president of the High Court that he may have grounds to challenge a tribunal decision regarding solicitor-client privilege and confidentiality.
Mr Justice Morris said he had not been persuaded that Mr Stephen Miley, solicitor for Jackson Way Properties Ltd, could challenge other decisions of Mr Justice Flood. These included attempts to quash a decision of the tribunal to retain documentation produced by Mr Miley under subpoena, and ordering him to give the tribunal the names of everyone who had given him instructions on behalf of the company.
Mr Miley, of Ashford, Co Wicklow had also sought orders declaring that the tribunal had acted beyond its powers. Mr Justice Morris adjourned the application until this morning.
