An action by a Co Tipperary woman against a farmer following a dispute over the alleged sale of lands was settled at the High Court yesterday.
Ms Sinead Mulcair, Main Street, Borrisokane, had sued Donal Brereton, Oldcourt, Carney, Nenagh, in a case which was listed to start before Mr Justice O'Donovan yesterday and last for two days.
But after talks between lawyers for both sides yesterday morning, Mr Edward Walsh SC, for Ms Mulcair, said the parties had reached an accommodation and certain terms had been reduced to writing. He asked the judge to receive the consent and adjourn the case until October 22nd next.
Mr Joseph Finnegan SC, for Mr Brereton, said a paragraph of the agreement contained an undertaking by his client in relation to certain properties. There was a confidentiality clause but he wished his client to give the undertaking to the judge. In reply to Mr Finnegan, Mr Brereton said he was aware the action had been settled on terms. He said he would undertake to comply with the terms set out in paragraph two.
Mr Justice O'Donovan said he was sure the parties had been well advised. He had read the papers in the case and had seen it could have been a troublesome matter.
