A senior counsel representing a young woman who suffers from cerebral palsy has argued in the High Court that his client's action against the Rotunda hospital should not be rejected on the grounds of a 19-year time gap. Mr Denis McCullough SC, for Ms Ruth Glynn (18), Grange Park Grove, Raheny, Dublin, yesterday contended the delay was excusable as his client had not received all the necessary records and reports to prosecute her claim.

Mr McCullough was opposing an application by the Rotunda for an order striking out the proceedings taken through Ms Glynn's father, Mr Kevin Glynn. The hospital claims the delay has seriously prejudiced its defence.

The hearing before Mr Justice O'Sullivan continues today.
