The Supreme Court has by a three-two majority quashed the energy regulator’s decision preventing electricity companies from including the new carbon tax in the prices at which they sell electricity. Viridian Power Ltd and Huntstown Power Company Ltd had brought judicial review proceedings against the Commission for Energy Regulation. Mr Justice Adrian Hardiman ruled that the levy should be included in the costs of generating. Mr Justice John Murray and Ms Justice Fidelma Macken agreed. The Chief Justice, Mrs Susan Denham, and Mr Justice Liam McKechnie dissented.
