A STUDENT who claimed he was punched by a barman has lost his claim for up to Pounds 30,000 damages.

Judge Patrick Smith was told Mr Desmond Fitzgerald, of Hatch Street, Dublin, and three friends went to Hourican's pub, Lower Leeson Street, in November 1994, after having watched a televised football match in another pub.

They had been twice refused service and asked to leave. Mr Fitzgerald claimed the barman, Mr James Cushnan, punched him in the face outside.

Mr Cushnan said the students were very drunk. He had struck Mr Fitzgerald in self-defence.

Judge Smith said both accounts were uncorroborated but as Mr Fitzgerald and his friends were drunk, he accepted the defendant's version.
