The Southern Health Board has told the High Court of its "heartfelt and deep regret" over events which led to a tragic case of a baby girl dying on the day of her birth in a Cork maternity hospital.
In court yesterday, Mr Aongus O Brolchain SC, for the Board, said great learning had been derived from the tragedy.
He was speaking after a settlement was announced in an action taken by Ms Maisie Costelloe, of Rivermeadows, Kinsale, Co Cork, against the SHB and Erinville Maternity Hospital in Cork city.
Ms Costelloe sued the Board for alleged negligence in connection with the birth and death of her infant daughter at the Erinville Hospital on July 15th 1994.The SHB denied negligence.
Mr Paul Sreenan SC, for Ms Costelloe, told Mr Justice Johnson the case had been settled. He said the full settlement, details of which were not disclosed to the court, included provision of £4,000 and £3,500 respectively for the mental distress of Mrs Costelloe and her husband. An undertaking to pay the remainder of the settlement as well as costs had been given by the SHB, counsel said.
