A schoolboy who suffered injuries after he was struck by a car while crossing a main road outside a playground was awarded €25,000 damages at the High Court yesterday.

Joshua Tier was aged nine when he ran into the side of a car on the Dublin-Longford road in Edgeworthstown, Longford, on October 3rd, 2009.

The boy, now 11, through his mother Barbara Tier, had sued the driver of the car for allegedly driving at excessive speed. He also sued Longford County Council, owners of the playground, over allegedly failing to erect adequate signage to warn of the road danger or to have a pelican crossing there.

The court heard his lawyers had recommended acceptance of a €25,000 offer because evidence would show the driver, Cathal Friel, Fieragh, Kilmore, Co Roscommon, was travelling at a reasonable speed and had no opportunity to avoid the collision.
