A Co Dublin restaurateur is to ask the High Court next week for an order restraining Mr Martin McCormack, of Coopers cafe and restaurant, Old Market Lane, Killarney, Co Kerry, from passing off his business as part of the Coopers restaurant chain throughout Dublin and Co Wicklow.

Mr Seamus Woulfe, counsel for Mr Peter Stokes, of Wilson Road, Mount Merrion, Co Dublin, told Mr Justice O'Donovan his client had started the chain 13 years ago. Two of the eight restaurants, which had an annual turnover in excess of £4 million, operated on a licence arrangement with pub-owners.

His client had learned of the Killarney restaurant through a half-page Getting Out column in The Irish Times and feared that irreparable damage could be done to his business if the McCormack enterprise was not restrained. Mr Stokes was granted short service of a notice of motion in the High Court next Wednesday.
