A KERRY factory worker charged with raping a mother of three told gardai she suddenly "freaked out" while he was having sex with her, a jury at the Central Criminal Court heard on the second day of his trial.

He said she had been "on top" of him on the passenger side of her car, and when he started to look for a condom she accused him of having raped her and ran over to a house and he saw her on her hands and knees at the door.

Supt Paul Mockler told the court the defendant also said he had earlier pushed the woman away from him and that was how she probably got some injuries on her face and body.

The 29-year-old alleged victim became very distressed while Supt Mockler gave his evidence on the second day of the trial, and ran from the courtroom followed by her husband and another woman.

Earlier Mr Justice Frederick Morris and the jury heard that when arrested by Garda Brendan O'Connor shortly after the alleged incident, the defendant denied anything had happened between him and the alleged victim.

The defendant had been seen by Gardai O'Connor and O'Sullivan walking near the scene of the alleged rape just after the gardai had secured her stationary car, which they had found with its doors opened.

The 27-year-old defendant denies three charges arising out of the incident on July 4th, 1993. He has pleaded not guilty to raping the woman, sexually assaulting her and assaulting her occasioning actual bodily harm.

Supt Mockler told Mr Patrick Gageby SC (with Mr Martin Collins), defending, he was not aware the defendant had not slept for more than about 15 minutes when he questioned him. The hearing continues.
