A prisoner in Mountjoy Jail will attempt to stop the three referendums in a High Court action tomorrow on the grounds that he is denied the vote.
Patrick O'Doherty, who is serving a two-year sentence for tax fraud, will argue that as a prisoner he is not entitled to vote and this violates his constitutional rights.
He will seek an injunction restraining the referendums on Thursday on Nice, the abolition of the death penalty, and the establishment of an international criminal court.
The Government will be defending the case, which is being handled by the Attorney General, Mr Michael McDowell SC.
Another prisoner, convicted arsonist Stephen "Rossi" Walsh won a High Court case last June when the judge ruled he had a right to vote in elections.
Mr Justice Quirke said the failure of the State to provide a means whereby Walsh could vote breached the constitutional guarantee of equality before the law.
The case was appealed by the Government to the Supreme Court and heard two weeks ago. The judgement has yet to be delivered.
