An application for leave to appeal to the Supreme Court a decision refusing permission to challenge the granting of planning permission for an apartment/hotel development at Ballsbridge in Dublin failed in the High Court yesterday.
Mr Justice McCracken rejected an application by Lancefort Ltd to appeal the High Court order refusing it permission to challenge the granting of planning permission for the development at Thomas Prior House, Simmonscourt, Ballsbridge.
Lancefort had sought to challenge the planning permission but last Monday the High Court ruled the application to quash the planning permission, granted to Rhode (Ireland) Limited, was statute barred and should have been brought within two months of August 13th last - the date when planning permission was granted.
