A pregnant woman and her brother who were last week granted an injunction ordering their grandfather to vacate their house have had the injunction upheld indefinitely.

At Galway Circuit Court yesterday, Judge Esmonde Smith upheld his original injunction in favour of Susan (23) David Jennings (21) until the dispute goes to a full hearing.

Last Thursday, Judge Smith ordered Mr Paddy Cummins of Cross, Co Mayo to vacate the house in Cong and to hand back the keys to his grandchildren, who had lived there until their mother's death last month.

Susan and David Jennings were left homeless when the house was forcibly occupied by Mr Cummins and his two sons.

Judge Smith ruled that Mr Cummins had acted illegally by evicting or dispossessing the plaintiffs without a proper court hearing. He granted them and their father, Mr John Jennings, an interim injunction directing Mr Cummins and his sons to vacate the house.

Yesterday, Judge Smith upheld the injunction by consent to allow the defence prepare a case for a full hearing and for the setting of a date for the hearing.
