A prison officer who is challenging his transfer to Wheatfield Prison after another officer made a complaint against him told the High Court yesterday that his salary was still being paid to him care of Mountjoy Prison.
Assistant Chief Officer Vincent Malone (47) alleges that he was wrongly transferred from Mountjoy to Wheatfield in 1994 and also claims that he was called a "scumbag" and a "bastard" by another prison officer, Ms Mary Tierney.
Ms Tierney complained that she had been harassed and degraded by Mr Malone "staring and glaring" at her, calling her a "slut" and making obscene remarks and gestures towards her.
Mr Justice O'Donovan, who is hearing the action by Mr Malone against the Minister for Justice and the Governor of Mountjoy Prison, is being asked to decide whether fair procedures were adopted by the authorities in relation to the manner in which Mr Malone was transferred.
In evidence yesterday, Mr Malone said that because his pay cheque was still care of Mountjoy, he assumed he was still attached to that prison. In the normal course of events when an officer was transferred the cheque was paid to the new "station" in the first week.
Lawyers for both sides were in discussion for almost two hours yesterday. The hearing resumes on Monday.
