Wayne O'Donoghue is ready to face an appeal against his four-year sentence for the manslaughter of his 11-year-old neighbour, according to his solicitor, Frank Buttimer.

"He [Wayne O'Donoghue] seems to be not too bad about it, he's going to face up to it and deal with it," Mr Buttimer said on RTÉ radio this morning.

"He accepts that there is a process and he was aware that there was going to be an opportunity for the DPP within the time constraint to lodge the motion of appeal" Mr Buttimer added.

Yesterday the Director of Public Prosecutions lodged an appeal against the four-year sentence.

O'Donoghue (21) was jailed last month for killing Robert Holohan at Ballyedmond, Midleton, on January 4th, 2005.

He had been acquitted of Robert's murder by a jury at the Central Criminal Court sitting in Cork in December. He pleaded guilty to the boy's manslaughter.

This morning Mr Buttimer said that he estimated it would take about six to nine months for the appeal case to be heard.

"Nothing additional or extraneous to the trial can be introduced, and effectively what will be considered will be the grounds of appeal, any submissions lodged of a legal nature by the prosecution and the defence and the transcripts of the evidence offered in the course of the trial," Mr Buttimer added.
