TALKS MAY continue today in a High Court dispute over claims by Michelle Morrison that her local council failed to protect her family’s privacy when dealing with planning permissions for the “Celtic Tiger-type” home of their neighbours in Dalkey, Co Dublin.
Ms Morrison, née Rocca, was in court yesterday for the continuing action against Dún Laoghaire Rathdown County Council, which opened on Tuesday. Her neighbours, Desmond and Mary Kavanagh, who are notice parties in the case, were also in court.
The case was due to resume yesterday before Mr Justice Michael Hanna but he was told discussions were taking place between the parties. Talks continued until late afternoon when Eamon Galligan SC, for Ms Morrison, who is singer Van Morrison’s wife, told the judge that while efforts had been made, it had not been possible to resolve matters at this stage.
Mr Justice Hanna, who had urged the parties on Tuesday to enter discussions, said he would adjourn the case until today.
Ms Morrison is seeking leave to quash a council decision to accept a notice of compliance with a planning permission issued to the Kavanaghs for the redevelopment of their home, which neighbours the Morrison home on Sorrento Road.
The council had accepted a compliance notice from the Kavanaghs which provided for the planting of shrubs between the properties when, Ms Morrison claims, it is trees that are required to protect her family’s privacy.
