A challenge by bankrupt developer Tom McFeely to the repossession by the National Asset Management Agency of his family home on Dublin’s Ailesbury Road will be heard in the High Court next month.
Last July, the High Court ruled Nama was entitled to repossession of the house after he defaulted on a €9.5 million mortgage.
Last week, Mr McFeely, whose company developed the Priory Hall apartment complex in Dublin, from which residents were removed more than a year ago due to fire safety concerns, claimed he and his family were now “on the side of the street”.
The case was mentioned again yesterday to High Court registrar Angela Denning, who was told that James Salafia SC, was representing Mr McFeely for his challenge.
A solicitor for Mr McFeely told the registrar that Mr Salafia would not be available to deal with the case within the next three weeks.
Ms Denning, who said she had been told last week by Mr McFeely that the matter was urgent, said the only alternative date after a three-week period would be in February.
She said she would set November 19th for the hearing.
