Johannesburg - South Africa's Constitutional Court yesterday upheld an appeal by former president Nelson Mandela against a High Court judgment in which his credibility as a witness was questioned by the sitting judge, Patrick Laurence reports. The judgment focused on a dispute between former South African Rugby Union president, Dr Louis Luyt, and former sports minister Mr Steve Tswhete and, through him, Mr Mandela.
High Court Judge Willem de Villiers found in favour of Dr Luyt, concluding Mr Mandela had unconstitutionally abdicated his power to appoint an inquiry into the affairs of the rugby union and making "an adverse credibility" finding against Mr Mandela.
